The family of the man accused of attacking a group of people Sunday with Molotov cocktails and a makeshift flamethrower has been taken into ICE custody and are being processed, a DHS official confirmed to CNN Tuesday.

"There is no precedent in the history of the United States for the type of collective family-based punishment," Eric Lee, an attorney for the suspect's wife and kids, said.

Homeland Security Secretary Kristi Noem said the agency would be investigating whether Mohamed Sabry Soliman’s family had information about his alleged plot.
