Joe Biden’s preemptive pardons are a valid use of pardon power. But they break new ground as a shield for those the president seeks to protect, scholars say.

Joe Biden, in one of his final acts as president, pardoned Dr. Anthony Fauci, retired Gen. Mark Milley and members of the House committee that investigated the Jan. 6 attack on the Capitol, in an extraordinary use of executive power to guard against potential “revenge” by the new Trump administration.

President Biden said the pardons are not an "acknowledgment that any individual engaged in any wrongdoing" but rather protect individuals from "unjustified and politically motivated prosectutions."
